1. Agreement to Terms
By accessing or using AquaHost services, including our website at aquahost.io and our game server hosting platform, you agree to be bound by these Terms and Conditions. If you do not agree to these terms, you must not use our services.
2. Service Provider
AquaHost is operated by Miteflux Technologies Ltd, a company registered in England and Wales with its registered office at 124 City Road, London, EC1V 2NX, United Kingdom.
For billing, account management, and support, we use third-party platforms including our billing system at billing.aquahost.io. Your use of those platforms is subject to their respective terms of service.
3. Services
AquaHost provides game server hosting services, including but not limited to Minecraft, Hytale, and other supported game servers. Services are provided on a subscription basis with monthly or other billing cycles as specified at the time of purchase.
We reserve the right to modify, suspend, or discontinue any service or feature at any time. We will endeavour to provide reasonable notice of material changes where practicable.
4. Account and Registration
You must provide accurate, current, and complete information when creating an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
You must be at least 18 years of age or have parental or guardian consent to use our services. By using our services, you represent that you meet these requirements.
5. Payment and Billing
All fees are due in advance according to your chosen billing cycle. Prices are displayed in GBP, EUR, or USD as applicable. UK customers are subject to 20% VAT where applicable. Prices for non-UK customers are exclusive of VAT unless otherwise stated.
Payment is required to maintain active services. Failure to pay by the due date may result in suspension or termination of your service. We may charge interest on overdue amounts at a rate of 8% per annum above the Bank of England base rate.
Refunds are handled in accordance with our refund policy. Generally, we do not offer refunds for partial periods or for services already consumed. Contact us at [email protected] for refund requests.
6. Acceptable Use
You agree not to use our services for any unlawful purpose or in any way that could damage, disable, or impair our systems or networks. Prohibited activities include but are not limited to:
- Hosting or distributing illegal content, malware, or pirated software
- Engaging in or facilitating harassment, abuse, or fraud
- Violating the terms of service of any game or software you host
- Attempting to gain unauthorised access to our systems or other customers' data
- Using excessive resources that negatively impact other customers
We reserve the right to suspend or terminate your service immediately if we reasonably believe you have violated these terms. We may also remove content that violates these terms without prior notice.
7. Service Level and Availability
We strive to maintain high availability but do not guarantee uninterrupted service. Scheduled maintenance will be communicated where possible. We are not liable for downtime caused by factors outside our reasonable control, including but not limited to DDoS attacks, third-party failures, or force majeure events.
You are responsible for maintaining backups of your server data. We recommend regular backups; we are not responsible for data loss.
8. Cancellation
You may cancel your service at any time through your billing account. Cancellation will take effect at the end of your current billing period. No refunds will be provided for the remainder of the paid period. Upon cancellation, your data may be deleted after a grace period; ensure you have exported any required data before cancelling.
9. Limitation of Liability
To the fullest extent permitted by law, Miteflux Technologies Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of our services.
Our total liability for any claims arising from or related to these terms or the services shall not exceed the amount you paid to us in the twelve (12) months preceding the claim. Nothing in these terms excludes or limits our liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.
10. Intellectual Property
All intellectual property rights in our services, website, and materials remain with Miteflux Technologies Ltd or our licensors. You retain ownership of content you upload to your servers. By using our services, you grant us a limited licence to host, store, and transmit your content as necessary to provide the services.
11. Governing Law
These terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
12. Changes
We may update these terms from time to time. We will notify you of material changes by posting the updated terms on our website and updating the "Last updated" date. Continued use of our services after changes constitutes acceptance of the revised terms. If you do not agree, you must stop using our services.
